Online store terms and conditions

The owner of the online store ELLA & ARTI's tiny FARM (hereinafter referred to as the Online Store) is Matsalu Lahe Kodu OÜ (registration code 16897222), located at Salevere tee 1-6, Salevere, 90116 Pärnumaa, Estonia.

Validity of the sales contract, product and price information

The terms of sale apply to purchases of goods from the Online Store. The prices of products sold in the Online Store are indicated next to the products.

A delivery fee is added to the price. All prices of goods sold in the Online Store are in euros.

The delivery fee depends on the buyer's location and the delivery method. The delivery fee is displayed to the buyer when placing an order.

Information about the goods is provided in the Online Store directly next to the goods.

Order processing

To order goods, you must add the desired products to the shopping cart. To complete the order, you must fill in the required data fields and select the appropriate delivery method for the products. The amount of the fee will then be displayed on the screen, which can be paid securely through the following payment methods:

  • Estonian bank payments
  • Finnish bank payments
  • Latvian bank payments
  • Lithuanian bank payments
  • Visa/Mastercard card payments
  • Apple Pay and Google Pay

NB! When paying with a bank link, be sure to click the "Return to merchant" button on the bank page.

Payments are made by Maksekeskus AS. Payment takes place outside the Online Store in a secure environment – when paying with a bank link, in the secure environment of the respective bank and when paying with a credit card, in the secure environment of Maksekeskus AS. The Seller does not have access to the customer's bank and credit card details. The Agreement enters into force upon receipt of the amount due to be paid to the Online Store's current account.

The owner of the online store is the controller of personal data and forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS.

If the ordered goods cannot be delivered due to the goods being out of stock or for another reason, the buyer will be notified as soon as possible and the money paid (including the costs of delivering the goods) will be refunded immediately, but no later than within 14 days of sending the notification.

Delivery

The goods will be shipped to the following countries: Estonia, Latvia, Lithuania, Finland.

The buyer has the following options to receive the goods:

SmartPosti (Estonia, Finland)

Omniva (Estonia, Latvia, Lithuania)

DPD (Estonia, Latvia, Lithuania, Finland)

Unisend (Estonia, Latvia, Lithuania)

The shipping costs of the goods are borne by the buyer and the corresponding price information is displayed next to the shipping method. The seller may bear the shipping costs as part of a campaign.

Shipments within Estonia generally arrive at the destination specified by the buyer within 3-7 working days from the entry into force of the sales contract. Shipments within Estonia are guaranteed to arrive within 14 calendar days. Delivery outside Estonia takes place within 14 calendar days.

In exceptional cases, the goods may be delivered within up to 45 calendar days.

For products that are not in our stock, the delivery time indicated in the product description is 3-14 days. For products that are in our stock, the delivery time is not added to the product description.

We will also send you products with a longer delivery time. You can return them to the parcel machine at this link. For larger shipments, write to info@tinymatsalu.com.

Most products are in our warehouse, larger items (furniture) may take longer to arrive, no more than 14 calendar days.

Right of withdrawal

After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days.

The right of withdrawal does not apply if the buyer is a legal entity.

To exercise the 14-day right of return, the ordered goods may not be used in any way other than what is necessary to verify the nature, properties and functioning of the goods in the same way as is permitted for testing the goods in a physical store.

If the goods have been used for a purpose other than what is necessary to verify the nature, properties and functioning of the goods or if they show signs of use or wear, the Online Store has the right to reduce the return fee according to the decrease in the value of the goods.

The seller pays for the return.

The buyer must return the goods within 14 days of submitting the return form or provide proof that he has handed over the goods to the carrier within the aforementioned period.

Upon receipt of the returned goods, the online store will immediately refund to the buyer, but no later than 14 days after receiving the withdrawal application, all fees received from the buyer under the contract.

The online store may refuse to make refunds until the item that is the subject of the contract has been returned or until the buyer has provided evidence that he has returned the item, depending on which occurs first.

If the buyer has expressly chosen a delivery method other than the cheapest standard delivery method offered by the online store, the online store is not required to refund the consumer the cost that exceeds the cost associated with the standard delivery method.

The online store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the online store is marked significantly below the market price of the goods due to a mistake.

Right to file a claim

The Online Store is liable for any non-conformity or defect of the goods sold to the Buyer that already existed at the time of delivery of the goods and that becomes apparent within two years from the date of delivery of the goods to the Buyer. Within one year from the date of delivery of the goods to the Buyer, it is assumed that the defect already existed at the time of delivery of the goods. It is the Online Store's obligation to rebut this presumption.

The Buyer has the right to contact the Online Store within two months of the discovery of a defect by sending an e-mail to info@tinymatsalu.com or by calling +372 5664 3642.

The Online Store is not liable for defects that have arisen after the goods have been delivered to the Buyer. If the goods purchased from the Online Store have defects for which the Online Store is liable, the Online Store will repair or replace the defective goods. If it is not possible to repair or replace the goods, the Online Store will refund all fees associated with the sales contract to the Buyer.

The online store will respond to the complaint submitted by the consumer in writing or in a form that can be reproduced in writing within 15 days.

Direct marketing and processing of personal data

The online store uses the personal data entered by the buyer only to process the order and send the goods to the buyer. The online store transfers personal data to companies providing transport services in order to deliver the goods.

The online store sends newsletters and offers to the buyer's e-mail address only if the buyer has expressed a desire to do so by entering their e-mail address on the website and has indicated their desire to receive direct mail notifications.

The buyer can opt out of offers and newsletters sent to the e-mail at any time by notifying us of this by e-mail or by following the instructions provided in the e-mail containing the offers.

If the buyer and the Online Store are unable to resolve the dispute by agreement, the buyer may contact the Consumer Disputes Commission. The Consumer Disputes Commission is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store. The review of the buyer's complaint by the Commission is free of charge.

PRIVACY POLICY

General provisions

This privacy policy regulates the principles of collection, processing and storage of personal data. Personal data is collected, processed and stored by the controller of personal data, Matsalu Lahe Kodu OÜ (hereinafter referred to as the data processor).

A data subject for the purposes of the privacy policy is a customer or other natural person whose personal data is processed by the data processor.

A customer for the purposes of the privacy policy is anyone who purchases goods or services from the data processor's website.

For what purpose is personal data processed

The bank account number is used to return payments to the customer. The IP address or other network identifiers of the online store user are processed to provide the online store as an information society service and to compile website usage statistics.

The processing of personal data is carried out for the performance of a contract concluded with the customer or for marketing purposes. The processing of personal data is carried out to fulfill a legal obligation (e.g. accounting and resolving consumer disputes).

Recipients to whom personal data is transferred

Personal data is transferred to the customer support of the online store to manage purchases and purchase history and to resolve customer problems. The Online Store is the controller of personal data, and the Online Store transfers the personal data necessary for making payments to the authorized processor LHV Bank.
