TERMS OF SALE OF THE ONLINE STORE

The owner of the online store ELLA & ARTI's tiny FARM (hereinafter the Online Store) is Matsalu Lahe Kodu OÜ (registration code 16897222), located at Salevere tee 1-6, Salevere, 90116 Pärnumaa, Estonia.

Validity of the sales contract, product and price information

The terms of sale apply to the purchase of goods from the Online Store.

The prices of the products sold in the Online Store are indicated next to the products. A fee for delivering the goods is added to the price. All prices of the goods sold in the Online Store are in euros.

The delivery fee for the goods depends on the location of the buyer and the method of delivery. The delivery fee is displayed to the buyer when placing an order.

Information about the goods is provided in the Online Store directly next to the goods.

Placing an order

To order the goods, the desired products must be added to the shopping cart. To place an order, you must fill in the required data fields and select the appropriate delivery method for the products. The amount of the fee will then be displayed on the screen, which can be paid securely through the following payment methods:

Visa/Mastercard card payments
Apple Pay and Google Pay

Payments are mediated; Maksekeskus AS. Payment takes place outside the Online Store in a secure environment - when paying with a bank link, in the secure environment of the respective bank, and when paying with a credit card, in the secure environment of Maksekeskus AS. The seller does not have access to the customer's bank and credit card details. The agreement enters into force upon receipt of the amount due to be paid to the Online Store's current account.

The owner of the Online Store is the controller of personal data and forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS.

If the ordered goods cannot be delivered due to the end of stock or for any other reason, the buyer will be notified as soon as possible and the money paid (including the costs of delivering the goods) will be refunded immediately, but no later than 14 days from the date of sending the notification.

The delivery of the goods may take longer than usual in cases where the goods need to be ordered again, if there is not enough of them, or if they are ordered from abroad.
If the delivery of the goods is disrupted for reasons independent of the Online Store, we will contact you ourselves, informing you of the problem. The missing or delayed goods can be replaced with another product or the order can be canceled.
Courier – when choosing a courier as the delivery person, the courier will contact you in advance and agree on a suitable time for delivery.
Parcel machine – in the case of Omniva, Itella SmartPOST and DPD parcel machines, the locker door code is sent to your mobile phone via SMS.
ELLA & ARTI's tiny FARM online store can be ordered without registering as a customer.

Shipping costs are borne by the buyer and the corresponding price information is displayed next to the shipping method.

Shipments within Estonia generally reach the destination specified by the buyer within 3-7 working days from the entry into force of the sales contract. Shipments within Estonia are guaranteed to arrive within 28 calendar days (for EU shipments within 14 calendar days).

In exceptional cases, the buyer has the right to deliver the goods within up to 45 calendar days.

Right of withdrawal

After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days.

Depending on the product, the buyer may not have the right of withdrawal; in this case, the corresponding products and services must be listed and must meet the conditions set out in Section 53(4) of the Law of Obligations Act.

The right of withdrawal does not apply if the buyer is a legal entity.

In order to exercise the 14-day right of return, the ordered goods may not be used in any way other than what is necessary to verify the nature, properties and functioning of the goods in the manner permitted for testing the goods in a physical store.

If the goods have been used for any purpose other than what is necessary to verify the nature, properties and functioning of the goods or if they show signs of use or wear, the Online Store has the right to reduce the return fee in accordance with the decrease in the value of the goods.

The costs of returning the goods are borne by the seller. The buyer must return the goods within 14 days of submitting the application or provide proof that he has handed over the goods to the carrier within the aforementioned period.

Upon receipt of the returned goods, the online store will refund to the buyer immediately, but no later than 14 days after receiving the withdrawal application, all fees received from the buyer under the contract.

The online store may refuse to make refunds until the item that is the subject of the contract has been returned or until the buyer has provided evidence that he has returned the item, whichever occurs first.

If the buyer has expressly chosen a delivery method other than the cheapest standard delivery method offered by the online store, the online store is not required to refund the consumer the cost that exceeds the cost of the standard delivery method.

The online store has the right to withdraw from the sales transaction and demand the return of the item from the buyer if the price of the item in the online store has been indicated significantly below the market price of the item due to an error.

Right to file a claim

The online store is liable for any non-compliance or defect of the item sold to the buyer with the terms of the contract that already existed at the time of delivery of the item and that becomes apparent within two years of the delivery of the item to the buyer.During this 1 year from the delivery of the item to the buyer, it is assumed that the defect already existed at the time of delivery of the item. It is the online store's obligation to rebut this presumption.

The buyer has the right to contact the online store within two months of the discovery of a defect by sending an e-mail to info@tinymatsalu.com or by calling: +372 5664 3642.

The online store is not responsible for defects that have arisen after the goods have been delivered to the buyer.

If the goods purchased from the online store have defects for which the online store is responsible, the online store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the online store will refund all fees associated with the sales contract to the buyer.

The online store will respond to the consumer's complaint in writing or in a form that can be reproduced in writing within 15 days.

Direct marketing and processing of personal data

The online store uses the personal data entered by the buyer only to process the order and send the goods to the buyer. The online store transfers personal data to companies providing transport services in order to deliver the goods.

The online store will send newsletters and offers to the buyer to the buyer's e-mail address only if the buyer has expressed a desire to do so by entering their e-mail address on the website and has indicated their desire to receive direct mail notifications.

The buyer can opt out of offers and newsletters sent to the e-mail at any time by notifying us by e-mail or by following the instructions in the e-mail containing the offers.

If the buyer and the online store are unable to resolve the dispute by agreement, the buyer may contact the Consumer Disputes Commission. The procedural terms and conditions can be viewed and an application submitted here. The Consumer Disputes Commission is competent to resolve disputes arising from the contract concluded between the buyer and the online store. The review of the buyer's complaint by the commission is free of charge.
